Welcome to BizLuma, a cloud-based business management platform (“BizLuma,” “Company,” “we,” “our,” or “us”).
These Terms & Conditions (“Terms”) govern your access to and use of our websites, mobile applications, and services (collectively, the “Services”).
By creating an account, subscribing, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use BizLuma.

1. Definitions

• “Account” means the unique profile created by a User to access the Services.

• “User” or “you” refers to any individual or entity that registers for or uses the Services.

• “Content” means all data, information, text, files, or other materials uploaded, stored, or transmitted through the Services.

2. Services Offered

BizLuma provides an integrated suite of modules, including but not limited to:

• Customer Relationship Management (CRM)

• Human Resource Management (HRM)

• Project & Task Management

• Point of Sale (POS)

• Billing, Invoicing, and Accounting

• AI-assisted productivity tools

We may add, modify, or remove features at our discretion. Any new modules are subject to these Terms.

3. Account Registration & Security

1. Eligibility: You must be at least 18 years old and legally capable of entering into a binding contract.

2. Accurate Information: You agree to provide true, current, and complete information during registration and to keep it updated.

3. Credentials: You are responsible for maintaining the confidentiality of your username and password and for all activities under your Account. Notify us immediately of any unauthorized use.

4. Subscriptions, Fees & Payment

1. Plans & Pricing: Subscription tiers and current pricing are displayed on our website or order form.

2. Billing: Fees are billed in advance on a monthly or annual basis, depending on the selected plan.

3. Renewals: Plans renew automatically unless cancelled before the renewal date.

4. Late Payments: Overdue amounts may incur interest at the maximum rate allowed by law and/or suspension of Services.

5. Taxes: Fees exclude applicable taxes, duties, and government charges, which are your responsibility.

5. User Content & Data Rights

1. Ownership: You retain all rights to your Content.

2. License to Us: You grant BizLuma a non-exclusive, worldwide, royalty-free license to host, store, and process your Content solely to provide and improve the Services.

3. Data Protection: We implement reasonable technical and organizational measures to safeguard your data.

4. Backup Responsibility: While we maintain backups for disaster recovery, you remain responsible for maintaining your own data backups.

6. Acceptable Use Policy

You agree not to:

• Violate any applicable law or regulation.

• Upload or transmit malicious code, viruses, or harmful data.

• Use the Services to send spam or unsolicited communications.

• Attempt to gain unauthorized access to other accounts or networks.

7. Intellectual Property

All trademarks, service marks, logos, software code, and content (other than your own Content) are the exclusive property of BizLuma or its licensors.
You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Confidentiality

Both parties agree to protect each other’s confidential information and use it only for purposes consistent with these Terms.

9. Service Availability & Maintenance

We strive for 99.9% uptime but do not guarantee uninterrupted access.
Scheduled maintenance or emergency downtime may occur, and we will provide reasonable notice whenever feasible.

10. Third-Party Services

The Services may integrate with third-party applications. Your use of those services is governed by the third parties’ terms, not these Terms.

11. Termination

• By You: You may cancel your account at any time through the dashboard or by written notice.

• By Us: We may suspend or terminate access if you violate these Terms or if required by law.

• Effect of Termination: Upon termination, your right to use the Services ceases immediately, but Sections relating to ownership, confidentiality, disclaimers, and liability survive.

12. Warranties & Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, BizLuma and its affiliates shall not be liable for:

• Indirect, incidental, special, or consequential damages.

• Loss of profits, revenue, data, or goodwill.
  Total liability for any claim shall not exceed the amount you paid for the Services in the preceding six (6) months.

14. Indemnification

You agree to defend, indemnify, and hold harmless BizLuma, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of Uttar Pradesh India, without regard to conflict-of-law rules.
Any dispute shall be resolved through binding arbitration or the courts located in Noida unless otherwise required by law.

16. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or prominent notice on the Platform. Continued use after such changes constitutes acceptance.
